Judgment awaited in Supreme Court Setanta case

The decision of the Supreme Court is still awaited in relation to the Motor Insurers’ Bureau of Ireland’s (MIBI) appeal against a decision that MIBI is potentially liable for claims brought against the collapsed insurer Setanta.

The Supreme Court case concluded in October 2016, when the Chief Justice, Ms. Justice Susan Denham indicated that the Court was reserving judgment. In March 2016, the Court of Appeal had upheld the High Court decision which found that the MIBI as opposed to the Insurance Compensation Fund, is potentially liable to cover the outstanding claims of policy holders following the liquidation of Setanta Insurance Company Limited in April 2014.

In November 2016, it was indicated that as many as 1,666 claimants were still waiting to be paid in respect of their claims.
