In some circumstances, the Department of Justice will permit change of status from Stamp 2 to Stamp 4. An example of this is where permission to remain is granted parents of Irish citizen children who are present in Ireland on student (stamp 2) or dependant of a non-EEA worker (stamp 3) permission. Stamp 3 permission does not allow engaging into employment whereas stamp 2 restricts the person to work only 20 hours per week (40 hours during academic holidays). The former IBC 05 scheme provided a formal application procedure for non- EEA parents of Irish citizen children to avail of stamp 4 permission. However, since the scheme ceased to exist there is currently no formal procedure of making an application. Each case is assessed individually and permission is granted at the discretion of the Minister for Justice.
