Bullying and stress disputes

McGrath McGrane LLP was instructed by a client who had an employment issue. The client had been subjected to a series of bullying incidents which led to the client being unable to attend the workplace and being medically certified unfit to do so.

The client had made the employer aware of the bullying issues. Certain investigations were held but unfortunately none of the actions taken by the employer resolved the issues to which the client was subjected. As a result of the bullying incidents, the client had effectively suffered personal injuries of a psychiatric nature.

It was important that the psychiatric injuries suffered by the client amounted to injuries that were classified as being a recognised psychiatric illness. McGrath McGrane LLP initiated a claim on behalf of the client and entered into correspondence and discussions with the client’s employer.

Ultimately, negotiations took place in relation to securing exit terms for the client from the said employment. An agreement was finally negotiated on behalf of the client which enabled the client to move on with their career together with a significant sum of compensation.
