Plate glass collision

The firm was instructed by a client who had the misfortune to walk into a plate glass window, as a result of which the client suffered serious personal injuries.

We advised the client of the possible difficulties which might be encountered if a potential defendant alleged that the client was the author of their own misfortune. Nonetheless, we also reassured the client that we were confident that we could succeed in recovering compensation for the client. We advanced the claim on behalf of the client and in due course submitted the claim to the Personal Injuries Assessment Board (PIAB).

After the claim had been processed by PIAB, it issued its assessment for a sum in excess of €80,000.00. The client was delighted with the assessment.

However, McGrath McGrane indicated to the client that we felt it was not enough. We advised the client that the assessment should be rejected on the basis that we could secure even more compensation for the client by issuing Court proceedings.

The client took our advice and rejected the assessment of PIAB. We subsequently issued proceedings on behalf of the client. During the course of the proceedings, we were invited to a settlement meeting at the Four Courts, Dublin 7. We attended the settlement meeting and following tough and protracted negotiations, we settled our client’s case for a sum in excess of €160,000.00.

Needless to say, the client was delighted with the result and that they had taken our advice to reject the PIAB assessment.
