Our employer client was brought before the Employment Appeals Tribunal by his former employee on a claim for unfair dismissal. The employee claimed he was unfairly selected for redundancy, on grounds that “last in first out” principal was not applied. The tribunal found that our client applied a fair selection process on the basis of the need to retain skills rather than applying the principle of “last in first out”, in order to secure the survival of the business. The unfair dismissal claim failed.
