Unfortunately, many of us, at some point in our lives, will be involved in some kind of accident, as a result of which we suffer an injury. Depending on how the injury has arisen, you may be entitled to compensation. The right to compensation will arise if you can prove that the negligence of the other party caused the accident and that the injuries were sustained as a result of the accident. This type of case is generally referred to as a personal injuries case.

In a personal injuries case, two major factors fall to be determined namely:-

  1. The liability issue - who is to blame for the accident.
  2. The quantum issue –the level of compensation the injured party is awarded.

If the person who has suffered the injury is successful in establishing that the party being blamed for the accident is responsible, then the quantum issue is determined, i.e. how much compensation the injured party should receive.

The compensation to which the injured party is entitled will comprise of “general damages” and “special damages”. General damages are awarded for the pain and suffering sustained by the injured party and special damages are made up of the expenses and financial losses which the injured party has incurred as a result of the accident.
